An important part of our service is to help you coordinate your estate planning with other aspects of your financial picture, such as investments, retirement planning, insurance and tax issues.
In partnership with a local attorney, we offer comprehensive estate preservation services. We can assist you in understanding the issues inherent in planning the transfer of your assets. We address tax planning, trusts for heirs such as children and grandchildren, charitable giving, selection of executors and trustees and asset titling. We can arrange for the preparation and execution of all estate documents including durable power of attorney for assets, durable power of attorney for health care and living will.
The key to making the right decision for your particular situation is information about the potential advantages and disadvantages of each option. For example, since probate has significant drawbacks, including complexity, cost, lack of privacy, delay, and danger of unintended disposition, most of our clients prefer to avoid it by using other estate alternatives. The more popular alternative for many people is the living trust (most of our clients have one).
A living trust has become popular for many reasons, including greater organization, greater assurance of complete probate avoidance and lower total cost than probate (compared to will preparation and probate, the combined cost of preparation and administration of the living trust is usually significantly less). Many people think of estate planning as encompassing only the issue of leaving property to their heirs. A living trust can facilitate management of your assets in the event of your incapacity. You can place just about any type of property in a living trust, and either withdraw or reinvest all of the income generated by trust assets during your lifetime. Since a living trust is a private agreement, information concerning the contents remains private. In addition, the flexibility of a living trust makes it ideal for a wide range of individuals.
